Anthony Bouyer sues Simi Entertainment Plaza LLC for alleged violations of the Unruh Civil Rights Act and ADA

In the Superior Court of California, County of Ventura, plaintiff Anthony Bouyer has filed a lawsuit against Simi Entertainment Plaza LLC and Does 1-10 (Case No. 2023CUC RO6637) on March 10, 2023. The suit alleges violations of the Unruh Civil Rights Act and seeks damages and injunctive relief.

The plaintiff, represented by attorney Joseph R. Manning Jr., alleges that he is substantially limited in performing major life activities such as walking, standing, moving about, sitting, and driving. He requires the use of leg braces for mobility stability, a walker or wheelchair for mobility, and hand control devices to drive his motor vehicle. On February 22, 2023, Bouyer visited the property owned by Simi Entertainment Plaza LLC at 2795 Tapo Canyon Rd, Simi Valley.

The complaint further states that despite being a business establishment and a place of public accommodation, there were no designated parking spaces available for persons with disabilities that complied with the ADA Standards for Accessible Design on February 22, 2023. This is alleged to be a violation of both the ADA and the UCRA.

Bouyer is seeking damages for this alleged violation of his civil rights under the Unruh Civil Rights Act and the Americans with Disabilities Act (ADA). He is also seeking injunctive relief to ensure future compliance with these laws by Simi Entertainment Plaza LLC.
