Vardui Asiryan sues Medical Staff of Glendale Adventist Medical Center for suspension without due process

In the Court of Appeal of the State of California, Second Appellate District, Division One, plaintiff Vardui Asiryan has filed a lawsuit against the Medical Staff of Glendale Adventist Medical Center and Glendale Adventist Medical Center et al., with case ID B316313 and B317728 respectively. The case was filed on February 29, 2024, and is related to the suspension of Asiryan's medical staff privileges at the defendant's medical center without prior notice or hearing.

Asiryan, represented by Fenton Law Group's Nicholas D. Jurkowitz and Dennis E. Lee, alleges that her privileges were suspended in October 2018 without due process. The defendants, represented by Cole Pedroza's Kenneth R. Pedroza and Scott M. Klausner, allegedly failed to comply with statutory and common law procedural requirements in suspending her privileges. She further claims that she was lied to about their obligations to report her suspension and resignation to the state licensing board.

The plaintiff seeks judgment against the defendants for failing to follow due process requirements for hospital peer review as per Business & Professions Code section 809 et seq. She also appeals from a judgment in favor of the Medical Staff arguing that court erred in its interpretation of relevant case law and denied her request to amend her complaint after trial had commenced.
