A California woman has filed a class action lawsuit against undergarments maker Hanes Brands, saying they should pay for allegedly improperly installing spyware on devices she used when accessing their website for their Maidenform clothing brand.
On Jan. 18, named plaintiff Miltita Casillas filed suit against Hanes in Los Angeles County Superior Court. The lawsuit was removed to Los Angeles federal court on Feb. 28.
The complaint accuses Hanes Brands of secretly deploying spyware on Maidenform's website that accesses visitors' devices, installs tracking software, and monitors their online habits after they leave the site. The plaintiff claims this was done without customers' knowledge or consent, allegedly in violation of California law.
Casillas is represented in the action by attorney Scott J. Ferrell, of Pacific Trial Attorneys, of Newport Beach.
The lawsuit marks the latest such class action, leveling similar claims, brought by this plaintiff and her lawyers against online sellers. Casillas and attorney Ferrell, for instance, earlier sued Zappos.com over similar accusations.
