Lawsuit claims solar panel installer LE Homes allegedly faked permits, other docs to get $1.8M from Haha Smart

Home solar energy system Haha Smart has filed suit against a subcontractor, LE Homes, claiming the contractor faked paperwork for solar installations that were never completed to allegedly bilk Haha out of nearly $2 million. 

The lawsuit was initially filed in December in Ventura County Superior Court, but was removed to federal court in Los Angeles on Feb. 12.

The lawsuit also names as a defendant LE's Chief Executive Officer Gigliola Martinez, and Western Surety Company and Business Alliance Insurance Company.

According to the complaint, LE Homes is based in Westlake.

The complaint accuses the defendants of alleged violations of the federal Racketeer Influenced and Corrupt Organizations Act (RICO), fraud/intentional misrepresentation, conversion/unjust enrichment, breach of contract, and claim on license bond. 

The lawsuit claims LE Homes allegedly submitted multiple false documents stating that solar installations on homes in and around Kern County, California, had been performed, completed and passed inspection, when they had not. 

The complaint asserts Haha paid LE Homes more than $1.8 million from Sept. 27, 2022, to July 17, 2023, in reliance on those allegedly false documents.
