Lawsuit accuses nursing home operators of discriminating against non-Korean resident applicants

A lawsuit has been filed against the operators of a group of nursing homes, accusing them of alleged discrimination against non-Korean individuals applying for residency and care in their facilities. 

The plaintiffs in the case are Zenaida Mojica, Lydia Mojica Behrens, and the Fair Housing Federation of Southern California. They are represented by Odion L. Okojie and David Tyalomhe.

The defendants named in the lawsuit include Spark Family Operations, LLC; Spark Family Properties, LLC; A Better Tomorrow Care Corp; Steve Kim; S.M. Healthcare, Inc; and New Healthcare Management, Inc; among others.

The plaintiffs allege that the defendants have engaged in a pattern or practice of unlawful discrimination based on race, color or national origin at their assisted living facilities. They seek monetary, declaratory, and injunctive relief as well as punitive damages, reasonable attorneys’ fees and costs for housing discrimination.

The case was filed Feb. 9 in Los Angeles federal court.
