Home cleanout services company 1-800-Got-Junk is facing a class action lawsuit for allegedly recording phone calls with customers without their consent.
The suit was filed Jan. 9 in Los Angeles federal court by attorney L. Timothy Fisher, of the firm of Bursor & Fisher, of Walnut Creek. It was filed on behalf of named plaintiff Justin Serna, of Fontana, who is seeking to lead the class action lawsuit on behalf of all people in California who allegedly also had their calls recorded by the company.
The complaint alleges that 1-800-Got-Junk, one of the largest residential waste removal companies in the US, has been monitoring and recording telephonic communications between consumers and its customer service representatives without first providing notice or obtaining the customer’s consent.
The complaint asserts this practice allegedly violates the California Invasion of Privacy Act.
The lawsuit seeks damages of $5,000 per alleged violation, as allowed under the law, plus attorney fees. According to the lawsuit, plaintiffs are seeking more than $5 million total.
