Class action accuses Zappos of allegedly secretly installing spyware

Zappos.com, an online fashion retailer, has been accused of secretly installing spyware on the devices of visitors to their website. 

The class action lawsuit alleges that the company used "pen register" software to access devices and install tracking software without users' knowledge or consent, in violation of California law. 

The case was initially filed in Los Angeles County Superior Court in November by plaintiff Miltita Casillas and her lawyers from Pacific Trial Attorneys. However, it was moved to Los Angeles federal court on December 29.

The lawsuit is one of several recently filed by the same legal team against different businesses for similar alleged violations. 

The attorneys argue that Zappos.com should be subject to jurisdiction in California as the company generates a significant portion of its revenue from interactions with Californians.

The lawsuit demands Zappos pay unspecified money damages, including statutory damages, punitive damages and attorney fees.

The plaintiffs are represented by attorney Scott Ferrell, of Pacific Trial Attorneys, of Newport Beach.
