A retired police officer, Juan Pagan Jr., has filed a lawsuit against the city of Fullerton and several of its police officers for allegedly using excessive force against him.

According to a lawsuit, the alleged incident occurred after an anonymous report was made about a Hispanic male on a motorcycle with a gun in his waistband. Pagan, who is licensed to carry a firearm, claims that he was mistreated during the stop.

The lawsuit was filed in the U.S. District Court for the Central District of California by attorneys Mark J. Skapik, Geralyn L. Skapik, Blair J. Berkley and Matthew T. Falkenstein, of Skapik Law Group, of Chino Hills.

The defendants named in the suit include Rene Valdes, Jaime Arroyo, Gharrett Wiltse, Travis Kowalec, Matthew Levin, Sergeant Diaz, Corporal Murphy, Corporal Cazares and 10 unnamed individuals.

Pagan is seeking compensatory and punitive damages for violations of various civil rights under the U.S. and California Constitutions.

Pagan has accused the defendants of excessive force, wrongful arrest, failure to intervene, assault, battery, false imprisonment and intentional infliction of emotional distress.
