Women's clothier Evereve accused in class action of alleged violations of California labor law

Women's clothing manufacturer Evereve is facing a class action lawsuit for alleged violations of California labor law. 

The suit, filed on behalf of Diana Smyth and all similarly situated current and former employees, accuses the company of shorting worker pay among other alleged infractions.

The allegations include unfair competition; failure to pay minimum wages and overtime wages; failure to provide required meal periods and rest periods; failure to provide accurate itemized statements; failure to reimburse employees for required expenses; and failure to pay sick pay wages, among other alleged violations of California labor laws.

The lawsuit was initially filed in Los Angeles County Superior Court in October, but was later removed to Los Angeles federal court on Dec. 27.

The plaintiffs have asked the court to order the employer to pay allegedly unpaid wages and expense reimbursements, plus penalties under the laws and attorney fees, among other damages.

The plaintiffs are represented in the action by attorneys from the firm of Blumental Nordrehaug Bhowmik De Blouw, of La Jolla, including Norman B. Blumenthal, Kyle R. Nordrehaug, Aparajit Bhowmik, Nicholas J. De Blouw and Piya Mukherjee.
