SAN DIEGO - Retail Services WIS Corporation, a retail inventory auditing firm, has been accused of allegedly underpaying its auditors overtime pay.
The lawsuit was filed Dec. 19 in San Diego federal court by Christina Cravens and Tonya Bearden on behalf of themselves and others allegedly in similar situations.
The plaintiffs claim that the company required them to work off the clock for tasks such as loading and unloading equipment, traveling between meeting places and audit sites, and receiving daily briefings. They estimate that they worked an average of 2.5 to 4 hours each shift that were not recorded or compensated by the company.
The case is brought as a collective action under the federal Fair Labor Standards Act, along with claims for violations of the Missouri Minimum Wage Law.
The plaintiffs are seeking compensation for all unrecorded and uncompensated work time, including overtime, liquidated damages, and other relief permitted by law.
They are represented in the action by attorneys John J. Ziegelmeyer III, Brad K. Thoenen, and Kevin A. Todd, of HKM Employment Attorneys LLP, of Kansas City, Missouri; and Cecilia N. Brennan, of HKM, of San Diego.
