A class action lawsuit accuses Kreation Juicery of sending marketing text messages to people without their consent, allegedly in violation of federal law.
The lawsuit claims the company is violating the federal Telephone Consumer Protection Act.
The lawsuit was filed in U.S. District Court for the Central District of California on behalf of lead plaintiff Dave Vaccaro.
According to the lawsuit, Vaccaro allegedly began receiving text messages from the company in June.
"Welcome to SMS message from Kreation Juicery Inc via Square – Reply to send us a message or 'STOP' to unsubscribe from receiving messages, std rates apply?," one such message read, according to the suit.
Vaccaro allegedly never gave his consent to receive text messages from the company, the lawsuit stated.
"The text messages sent to Plaintiff’s cellular telephone were sent in an automated fashion as a result of computerized campaigns that were pre-
programmed in advance to send messages out to large groups of consumers all at once, either sequentially or via algorithmic dialing, i.e. in an automated fashion by a computer," the lawsuit states.
Vaccaro is charged by his cell phone carrier for incoming texts, the suit states.
It seeks $500 for "each and every" violation of the law, plus attorney fees and court costs.
The plaintiffs are represented by attorneys Todd M. Friedman and Adrian R. Bacon, of the Law Offices of Todd M. Friedman, of Woodland Hills.
