Lawsuit accuses Ford of knowingly selling vehicles with a faulty transmission

A class action lawsuit filed against Ford Motor Company accuses the car maker of knowingly selling vehicles with a faulty transmission. The complaint was filed on Sept. 27 in Los Angeles federal court.

Plaintiffs filed the lawsuit on behalf of consumers who purchased or leased a Ford vehicle equipped with a 10R80 10-speed transmission. They claim Ford knew or should have known that these vehicles have design or manufacturing defects, including the 10R80 automatic transmission.

According to the suit, the transmission can shift harshly and erratically, causing the vehicle to jerk, lunge, clunk, hesitate, surge or slip between gears. Some consumers have also reported a sudden loss of power while driving their vehicles. 

The class action states that the defect in the 10R80 transmissions is a potentially life-threatening safety issue and that Ford has refused to recall or replace the defective transmissions, stating that the abrupt and harsh shifting is “normal.” 

Ford’s warranty states, “dealers will, without charge, repair, replace, or adjust all parts on your vehicle that malfunction or fail during normal use during the applicable coverage period due to a manufacturing defect in factory-supplied materials or factory workmanship.”

The plaintiffs have requested a jury trial and are represented by attorneys with the firm of Milberg Coleman Bryson Phillips Grossman, PLLC.
