David Brisco and Howard Maycon will present a Cozen O'Connor webinar titled, "A Subrogating Carrier’s Best Resource – The Role of the Insured in the Investigation and Litigation of Subrogation Claims" on Thursday, October 21, 2021. This webinar will discuss the requirements, in some states, that subrogation carriers notify insureds of whether subrogation is being pursued. Additionally, the presentation will discuss in depth that even where the subrogation carrier is not required to notify the insured, the subrogation carrier should want to involve the insured in the investigation process due to the myriad ways in which insureds can help with proving a subrogation case. The presentation will address important rules when co-litigating a subrogation case with the insured, including made whole, pro-rata, and joint prosecution considerations.
