San Luis Obispo officer accused of assaulting man having mental health episode

LOS ANGELES - The City of San Luis Obispo, a San Luis Obispo Police Department officer and the French Hospital Medical Center were accused of medical negligence and assault and battery in federal court. 

The complaint was filed by plaintiff Noah Alexander Zwarg on April 26 in the U.S. District Court for the Central District of California. According to the complaint, Zwarg was experiencing a bipolar episode on June 26, 2020, at his residence in San Luis Obispo shared with a roommate. The roommate then called the police department concerned after the plaintiff left. 

Defendant officer Kylee Bailey arrived at the residence and determined that Zwarg should be admitted to French Hospital for a mental health evaluation, the suit says.

Zwarg was left unattended at the hospital and began to walk home while half-naked as a result, the suit says. Defendant Bailey saw him on the sidewalk and allegedly attempted to restrain him with physical force despite being aware of his mental distress. 

The city and Officer Bailey are charged with excessive force, civil code violations, and assault and battery. French Hospital is charged with medical negligence.
