Widow of lumber accident victim seeks payback in Fresno County court

FRESNO - A Fresno County widow filed wrongful death charges filed against Welker's Custom Cut Lumber and Mountain Property Services of Auberry after the companies allegedly caused her husband's death.

According to documents filed on March 16 in the Fresno County Superior Court, Vance Fleming was an 18-wheeler diesel lumber truck driver. He was picking up lumber from the defendant Mountain Property Services on August 8, 2020, and was unloading it to defendant Welker's Custom Cut Lumber.

Through an event not described in the suit, Fleming allegedly died as a result of negligent possession, control, maintenance, loading or unloading of the lumber. 

The defendants are charged with negligence and premises liability by Fleming's surviving wife, Lynn, and their two children. 

The plaintiffs are represented by Sutton and Murphy.
