FRESNO - A mother and daughter who lost their husband and father in an industrial workplace accident want his former employers to be held responsible in the Fresno County Superior Court, according to documents filed on March 1.
Plaintiff Maria Arce is the widow and plaintiff Guadalupe Crosland-Davis is the daughter of Alfredo Arce, a former employee of defendant Performance Welding and Machine of Nevada, owned by defendant Sarah Oergel. The lawsuit says that Performance was barred from doing business in both California and Nevada before and at the time of Arce's death for unspecified reasons.
Performance was hired by defendant Foster Poultry Farms of Fresno in 2019. According to the suit, Arce was working at the farm where large electrical panels were being unloaded off of a semi with a forklift. A panel tipped off the forklift onto the decedent, resulting in his injuries and death, the suit claims.
The defendants are charged with liability based upon failure to procure and maintain workers compensation insurance and negligence.
