Apartment building owner sued after boy falls from second-story bedroom window

LOS ANGELES - A lawsuit alleging negligence and infliction of emotional distress was filed by a Camarillo family against San Diego Family Housing, LLC, Lincoln Military Property Management, LP and Texas Lincoln Property Company, according to February 5 documents in the Los Angeles County Superior Court. 

Plaintiffs Anthony Chavira and Annel Chavira are the parents of plaintiff Arian Jonah Chavira. The family lived in an apartment located at 988A Calle La Cumbre in Camarillo, owned and managed by the defendants. 

On May 12, 2020, the parents were in the kitchen on the first floor and the son, Arian, was in a second-story bedroom. Through events not described in the lawsuit, Arian allegedly fell out of a window to a concrete floor roughly 15 feet below, sustaining a fractured skull, respiratory failure and brain injury.

The parents accuse the defendants of being responsible for the incident by not securing the window enough. 

The defendants are charged with premises liability, general negligence and negligence per se and negligent infliction of emotional distress. The family is represented by Burneikis Law. 

The defendants removed the case to Los Angeles federal court in March.
