Fresno County landlord cornered in suit after letting rental units allegedly deteriorate past safe inhabitation

FRESNO - A Fresno County landlord was named in a lengthy Fresno County Superior Court lawsuit that alleges failure to provide a habitable dwelling and other charges. 

According to documents filed on February 19, plaintiffs Charles Powell and Catrina Fields were renters of a property owned by defendant PGA Fresno LLC at 2029 N. Orchard St. from September 2018 to October 2019. The property was a multi-family unit and included low-income housing.

The 141-page lawsuit accuses PGA Fresno of neglecting the property until it became unsuitable for inhabitation, including: infestations of bedbugs, cockroaches, spiders, silverfish and mice; windows and doors that were not weatherproofed, thus susceptible to cold weather and rain; defective air conditioning; a burning electrical smell in one of the bedrooms and frequent blown fuses; low water pressure; rattling pipes in shower, clogged plumbing and leaky faucets; mold and mildew; water leaks in ceilings when rain occurred; defective refrigerator; and holes/cracks in walls and floors throughout the units. 

The plaintiffs also say they were harassed by the defendant when these issues were addressed. 

PGA Fresno is charged with failure to provide habitable dwelling, breach of covenant and right to quiet enjoyment and possession of the property, nuisance and negligence. The former tenants ask the court for a rent abatement and other damages deemed fit. They are represented by Elder and Spencer LLP.
