Lawsuit filed against Central Unified School District over playground mishap

FRESNO - A Fresno County man and his 10-year-old son sued the Central Unified School District, a student and a playground equipment manufacturer after his son was injured on the Teague Elementary School playground, according to documents filed on Feb. 10 in the Fresno County Superior Court. 

Plaintiffs Carlos Gonzalez and his son Miguel Angel Gonzalez Perdoza say that Miguel was playing on the Teague playground at recess, when the Teague faculty member responsible for overseeing recess left the area he was supposed to be supervising. The defendant, fellow student Maximiliano Bucio Gutierrez, allegedly jumped through a gap in the upper deck of the playground equipment and landed on Miguel, who was on the ground level. 

CUSD is sued for negligence in not supervising children on the playground, negligent failure to carry out mandatory duty under Education Code and dangerous conditions/premises liability. The Teague Elementary student is sued for battery and negligence. Defendant Playcore Wisconsin Inc, the playground equipment manufacturer, is sued for negligence in manufacturing and selling dangerous equipment and strict products liability. 

The plaintiffs are seeking are seeking at least $50,000 in damages and are represented by Baker Manock and Jensen PC.
