Lawsuit: Volkswagen Passat's faulty airbags to blame for serious injuries in accident

FRESNO - Volkswagen and Fresno repair shop Michael Cadillac Inc. are facing civil charges in the Fresno County Superior Court from a Fresno man who was injured in a car accident in which his Volkswagen Passat's front airbags failed to deploy, according to court documents filed on Jan. 25. 

The plaintiff is Hubert Williams, who was driving a 2014 Volkswagen Passat in November. Williams says he was knocked unconscious when he rear-ended another vehicle, and was transferred to a local Intensive Care Unit. 

As a result of the Passat's airbags not deploying, Williams sustained injuries including a fractured collarbone, a hip replacement, a fractured right knee, facial lacerations and other injuries, the suit says.

Michael Cadillac was the ongoing service provider for the vehicle, the suit says, and failed to keep the vehicle out of a state of disrepair. 

Williams is pressing Volkswagen Group of America for one count of strict liability in a manufacturing deficit, one count of strict liability in a design deficit, one count of negligence and one count of breach of express warranty. Michael Cadillac is facing one count of negligent repair. 

The plaintiff is seeking compensatory damages, judgements and litigation fees. Williams is represented by MLG, APLC.
