LITTLER MENDELSON PC: COVID-19 Labor & Employment Litigation Tracker

Littler Mendelson issued the following announcement on July 24.

Since March 17, there have been 415 lawsuits (including 50 class actions) filed against employers due to alleged labor and employment violations related to the coronavirus.  The filings have increased rapidly over the past few months:

  • 7 complaints from March 17 – 31;
  • 52 complaints in April;
  • 100 complaints in May;
  • 145 complaints in June; and
  • 111 complaints as of July 23.
California is leading the way with 71 cases filed, with Florida (49), New Jersey (44), and New York (38) following closely behind. The most common complaints have focused on retaliation (129), wrongful termination (112), discrimination (84), and workplace safety (73). The healthcare industry has been hardest hit by COVID-19 employment litigation with 90 alleged violations.
