In a significant legal move, Blue Energy Holdings LLC has filed a lawsuit against several defendants, including individuals and a real estate company, over alleged fraudulent activities related to a property transaction. The complaint was lodged in the Superior Court of California, County of Ventura on April 1, 2025. The defendants named in the case are Todd J. Mitchell, Domonique Rodriguez, and Pickford Real Estate Inc., which operates under the name Berkshire Hathaway HomeServices California Properties.

The lawsuit stems from Blue Energy Holdings' purchase of a property located at 11465 Nardo Street in Saticoy, California. According to the complaint, Blue Energy Holdings entered into an agreement to buy the property from Todd J. Mitchell for $685,000 on March 28, 2022. However, the plaintiff alleges that they were misled about critical aspects of the property by Mitchell and his associates during the sale process. Among the allegations are claims that Mitchell failed to disclose that the neighborhood was gang-infested and that there were serious issues with the property's legality as a duplex. Additionally, it is claimed that there were undisclosed defects such as needing a new roof and other structural repairs.

Blue Energy Holdings asserts that these omissions constitute intentional misrepresentation and suppression of facts—actions they argue are fraudulent under California law. "Had Plaintiff known the true facts concerning the condition of the Property," states the complaint, "Plaintiff would not have purchased the Property or would have purchased it under different terms." As part of their legal strategy, Blue Energy Holdings is seeking rescission of the contract along with compensatory damages exceeding $1 million for renovation costs and other expenses incurred due to these alleged misrepresentations.

The legal filing also highlights breaches of statutory duties by both Mitchell and Rodriguez as well as Berkshire Hathaway HomeServices California Properties. It is alleged that these parties failed to conduct adequate inspections or provide necessary disclosures about material defects affecting property value—a violation of California Civil Code sections governing real estate transactions.

In addition to seeking rescission of their purchase agreement with Mitchell, Blue Energy Holdings demands general damages according to proof at trial for each cause of action listed in their complaint—including fraud and breach of contract—alongside punitive damages aimed at deterring similar misconduct by others in future dealings.
