On April 1, 2025, Jose Manuel Jr Jimenez lodged a complaint in the Superior Court of California, County of Ventura, against General Motors LLC. The plaintiff, Jose Manuel Jr Jimenez, a resident of Canoga Park in Los Angeles County, claims that General Motors LLC failed to uphold its obligations under the Song-Beverly Consumer Warranty Act. The complaint revolves around a 2024 GMC Sierra HD vehicle purchased by Jimenez on May 26, 2024. According to the filing, the vehicle exhibited numerous defects and malfunctions that were not rectified despite multiple repair attempts by authorized facilities. Jimenez asserts that these issues significantly impaired the vehicle's use, value, and safety.

Jimenez accuses General Motors LLC of breaching both express and implied warranties under California law. The plaintiff argues that the company did not conform the vehicle to its written warranties within a reasonable timeframe or replace it as required by law. "Defendants violated the Song-Beverly Consumer Warranty Act by failing to conform the Vehicle to the express written warranties," states the complaint. Furthermore, Jimenez alleges that General Motors' failure to address these defects was willful and seeks civil penalties amounting to twice his actual damages.

The lawsuit seeks various forms of relief from the court. Jimenez requests a declaration rescinding the sales contract and demands restitution for all payments made towards the vehicle's purchase price. Additionally, he seeks consequential and incidental damages totaling $114,864.50 according to proof at trial. The plaintiff also calls for civil penalties under the Song-Beverly Act and reimbursement for attorney’s fees incurred during this legal process.
