The legal battle intensifies as a couple files a lawsuit against a major retail corporation following an unfortunate incident. On February 21, 2025, Annette and Warren Gerosa filed a complaint in the Superior Court of California, County of Ventura, against Marshalls of CA, LLC, TJX Companies, Inc., and other unnamed defendants. The plaintiffs allege negligence, premises liability, and loss of consortium due to injuries sustained by Annette Gerosa on the defendant's property.
According to the court documents, Annette Gerosa was injured on March 5, 2023, while visiting the Marshalls store located at 1835 Ventura Blvd., Oxnard, California. The complaint details that she slipped and fell on packaging material left on the floor near the restrooms. This fall resulted in severe injuries to her body and nervous system. The plaintiffs argue that these injuries were caused by the negligent maintenance and operation of the premises by Marshalls of CA, LLC; TJX Companies, Inc.; and other associated parties. They assert that the defendants failed to provide safe flooring or warn customers about potential hazards.
The Gerosas' complaint further alleges that there is a unity of interest between various defendants named in the lawsuit. It suggests that certain individuals or entities completely controlled and managed these corporations to such an extent that their separate identities ceased to exist. This assertion aims to hold all parties accountable for Annette's injuries under claims of negligence and premises liability.
In addition to seeking compensation for medical expenses and general damages for pain and suffering endured by Annette Gerosa due to her injuries, Warren Gerosa also seeks damages for loss of consortium. He claims that his wife's injuries have deprived him of her care, comfort, society, counsel, services, and companionship.
