Esperanza Munoz, the plaintiff, lodged her complaint on December 17, 2024, in the Superior Court of Ventura County against Los Robles Regional Medical Center and The Ensign Group, Inc., doing business as Camarillo Healthcare Center.
The case revolves around Munoz's stay at these medical facilities from December 17, 2023, to February 14, 2024. According to the complaint, Munoz was initially admitted to Los Robles Regional Medical Center where she developed rashes and sores on her body. These conditions reportedly worsened after her transfer to Camarillo Healthcare Center under The Ensign Group's management. The plaintiff claims that inadequate care led to severe infections and life-threatening wounds. "Defendants failed to provide necessary care," states the complaint, highlighting issues such as poor hygiene practices and insufficient repositioning that allegedly resulted in bedsores and dehydration.
Munoz accuses both healthcare providers of breaching their duty of care under California law by neglecting basic health standards set by the California Department of Public Health. She asserts that this neglect constituted physical elder abuse under the Elder Abuse and Dependent Adult Civil Protection Act (EADACPA). Additionally, she alleges medical negligence due to failure in diagnosing and treating her worsening condition.
