A class action lawsuit has been filed against a California roofing company for alleged labor violations, including failure to compensate employees for all hours worked and missed meal and rest breaks. The complaint was lodged by Josue Cifuentes on December 2, 2024, in the Ventura Superior Court against All Climate Roofing Inc., Charles T. Petri, and other unnamed defendants.

The plaintiff, Josue Cifuentes, claims that he and other similarly situated employees were systematically denied proper compensation for overtime work and missed breaks during their employment with All Climate Roofing Inc. The complaint outlines several allegations against the defendants, including violations of the California Labor Code and Industrial Welfare Commission orders. According to the lawsuit, Cifuentes worked as a laborer from April 2024 until August 26, 2024, often exceeding 60 hours per week without receiving appropriate overtime pay. The suit alleges that the company had a practice of not accounting for overtime hours despite employees working over 12 hours a day.

Cifuentes further accuses the defendants of failing to provide accurate wage statements and not reimbursing business expenses incurred by employees. He claims that workers were pressured to complete tasks without taking legally mandated meal and rest breaks. "Plaintiff and other non-exempt employees routinely worked without being provided with proper thirty-minute timely and uninterrupted, duty-free meal periods," states the complaint.

The lawsuit seeks various forms of relief from the court, including compensatory damages for unpaid wages, penalties under several sections of the California Labor Code, restitution for unfair business practices under Business & Professions Code §17200 et seq., as well as civil penalties under PAGA (Private Attorneys General Act). Additionally, Cifuentes is seeking attorneys' fees and costs associated with bringing this action.
