Elvia Martinez Quileo has filed a class action lawsuit against her former employers, alleging numerous violations of California labor laws. The complaint was lodged in the Superior Court of California for Ventura County on November 18, 2024, targeting Lincoln Group Industrial Services LLC, Consolidated Foundries, Inc., and Pac Foundries, Inc. The case highlights significant issues surrounding wage theft and unfair business practices within these companies.

Quileo's lawsuit accuses the defendants of failing to pay minimum wages and overtime compensation as required by the California Labor Code. Additionally, she claims that they did not provide mandated meal periods or authorize rest breaks. The plaintiff also alleges that the companies failed to indemnify necessary business expenses and did not issue accurate itemized wage statements. "Defendants maintained a systematic, company-wide policy and practice" of violating labor laws, according to the complaint. These alleged actions have resulted in significant financial harm to Quileo and other similarly situated employees.

The lawsuit further details how these practices have led to unfair business operations under California Business & Professions Code §§ 17200 et seq. Quileo asserts that these violations were willful and deliberate, emphasizing that the defendants were aware of their legal obligations but chose not to comply. As a result, she seeks various forms of relief from the court including unpaid wages with interest, statutory penalties for late payment of wages upon termination, reimbursement for incurred business expenses, damages for inaccurate wage statements, restitution under unfair competition laws, injunctive relief to prevent future violations, and attorneys' fees.

Representing Elvia Martinez Quileo are attorneys Seung L. Yang and Tiffany Hyun from The Sentinel Firm APC. The case is being overseen by Judge Brenda L. McCormick under Case No.: 2024CUOQE033449 in Ventura Superior Court.
