Jones Day Intellectual Property Practice leader Anthony M. Insogna was named to the San Diego Business Journal "Leaders of Influence in Law" list for 2024. The list honors the region's lawyers for their contributions to the community and commitment to their profession.
Mr. Insogna is a patent lawyer with more than 30 years of experience representing innovative and leading life sciences companies. His experience ranges from litigation enforcement and defense of patents, to development of patent strategy, to advising on due diligence. Significant recent wins by Mr. Insogna and his teams include:
- a jury trial win in a patent infringement case brought by Puma Biotechnology, Inc. and its licensor Wyeth LLC against AstraZeneca Pharmaceuticals LP's Tagrisso® product, a multibillion-dollar non-small cell lung cancer therapy, with a damages award of $107.5 million (currently on appeal);
- a bench trial win in a Hatch-Waxman case to protect against generic infringement of Merck Sharp & Dohme, B.V.'s BRIDION® product, a first-in-class agent for the reversal of certain types of neuromuscular blockade induced in adults undergoing surgery, where the district court sided with Merck in rejecting the defendants' argument that Merck's patent term extension was invalid (currently on appeal); and
- successful retention of ToolGen, Inc.'s senior party status and successful reversal of examiner rejections of ToolGen's claims directed to methods and compositions for using CRISPR/Cas9 gene editing technology in mammalian cells, as part of ongoing PTO multi-patent interferences between ToolGen and competitors.
