Patients Sue Los Robles Regional Medical Center Over Elevator Malfunction

A malfunctioning elevator at a California hospital has led to a personal injury lawsuit, with plaintiffs alleging negligence and seeking compensation for damages. The complaint was filed by Victoria Gonzalez and Victor Gonzalez in the Superior Court of California, County of Ventura, on September 18, 2024, against Los Robles Regional Medical Center and its associated entities.

According to the complaint, Victoria Gonzalez visited the emergency department at Los Robles Hospital on September 28, 2023, due to chest pain. After being discharged, she and her husband Victor Gonzalez were involved in an incident where the hospital's parking garage elevator malfunctioned. The elevator abruptly stopped and crashed down violently, causing Victoria Gonzalez to suffer a concussion along with injuries to her neck, upper back, and shoulders.

The plaintiffs argue that the defendants failed in their duty of care by not maintaining the elevator in safe working condition. Specific allegations include neglecting routine inspections and failing to hire qualified maintenance personnel. The complaint states: "Defendants negligently failed to maintain an elevator on their property in suitable, safe working condition so as not to endanger patients and other patrons." As a result of these alleged failures, Victoria Gonzalez incurred significant medical expenses and endured physical pain and suffering.

Victor Gonzalez also claims loss of consortium due to his wife's injuries. He asserts that prior to the incident, Victoria was able to perform her duties as a spouse but has since been unable to do so. This includes providing care, comfort, society services, and support within their marriage.

The plaintiffs are seeking various forms of relief from the court. For negligence claims, they request general damages according to proof at trial for medical expenses and related costs. Additionally, they seek special economic damages for Victor's loss of his wife's companionship and support. They also ask for non-economic damages related to emotional distress caused by the incident.
