Starbucks sued over alleged negligence after customer’s slip-and-fall injury

A slip and fall incident at a popular coffee chain has led to a lawsuit alleging negligence and premises liability. Iosif Oncu filed the complaint against Starbucks Corporation in the Superior Court of California, County of Los Angeles, on June 18, 2024.

According to the court documents, Oncu claims that on June 24, 2022, he suffered serious injuries after slipping and falling in a restroom at a Starbucks store located at 202 S. Beverly Drive, Beverly Hills, CA. The plaintiff alleges that the floor was wet, grimy, and dangerously slippery due to negligence on the part of Starbucks Corporation and other unnamed defendants (DOES 1-100). Oncu asserts that these conditions were not adequately addressed or warned about by the defendants.

The complaint details how Oncu believes Starbucks Corporation failed in its duty to maintain safe premises for its customers. "Defendant Starbucks Corporation and DOES 1 through 100 were negligent in ownership, possession, leasing, rental, occupation, designation, construction, development, inspection, repair, maintenance, modification, management, control," reads one section of the filing. The plaintiff argues that this negligence directly resulted in his slip and fall accident.

Oncu's lawsuit includes two primary causes of action: general negligence and premises liability. He claims that as an invitee on the premises acting reasonably at all times mentioned herein," he was owed a duty of care by Starbucks Corporation to keep the area safe. The complaint further alleges that the defendants breached this duty by failing to prevent or remedy the hazardous condition in their restroom.

The plaintiff is seeking various forms of relief from the court. These include general damages according to proof; costs incurred for medical services such as hospitals and physicians; loss of income; loss of present and future earning capacity; costs of suit; prejudgment interest; and any other economic or pecuniary damages deemed appropriate by the court.
