Resident Sues Dog Owners Over Vicious Attack

A Ventura County resident has filed a lawsuit against multiple defendants for damages stemming from a violent dog attack. On August 6, 2024, Consuelo Ramirez submitted a complaint to the Superior Court of California, County of Ventura, accusing Gabriel Garcia, Ana M. Melgoza, Jose Luis Melgoza Jr., and unnamed parties of negligence and strict liability in connection with the incident.

According to the court documents, the plaintiff alleges that on August 22, 2022, she was viciously attacked by a large dog owned and controlled by the defendants. The complaint states that the dog had previously bitten another person and was known to possess dangerous propensities. Despite this knowledge, the defendants allegedly failed to properly supervise or contain the animal. "Defendants so negligently, carelessly owned, maintained, and/or controlled said DOG causing it to aggressively and in a violent manner, viciously attack and bite plaintiff's person," reads one part of the filing.

Ramirez claims that as a result of this attack, she sustained significant injuries affecting her health and well-being. The document outlines various physical injuries as well as mental anguish caused by the incident. It also mentions potential permanent disability resulting from these injuries. Additionally, Ramirez argues that she has incurred substantial medical expenses for surgery and hospitalization and will continue to face such costs in the future.

The lawsuit seeks general damages exceeding the minimum jurisdictional limits of the court for pain and suffering endured by Ramirez. Furthermore, it demands compensation for lost earnings and diminished earning capacity due to her inability to work following the attack. The plaintiff also requests reimbursement for medical expenses related to her treatment and other incidental costs.
