Plaintiff Alleges Negligence Against Defendants Following Serious Car Accident

A high-stakes legal battle has erupted in Ventura County, California, where Jaime Calderon has filed a lawsuit against Ruth Katherine Ewald and Bruce Ewald, alleging negligence that resulted in a serious car accident. The complaint was officially submitted by Sweet James, LLP on June 11, 2024.

According to the court documents filed in the Superior Court of California for the County of Ventura under Case No. 2024CUPA025772, Calderon claims that on September 29, 2023, at approximately noon, he was involved in a collision with a vehicle operated by Ruth Katherine Ewald at the intersection of Los Angeles Avenue and Miller Parkway in Moorpark. Calderon alleges that Ruth Ewald was driving at an unsafe speed and ran a red light, leading to the crash that caused him significant injuries.

The complaint outlines that both Ruth Katherine Ewald and Bruce Ewald owned and controlled the 2010 Mercury Mountaineer involved in the incident. It further accuses them of failing to operate their vehicle with ordinary care and skill necessary to avoid causing harm. "Defendants RUTH, BRUCE and DOES 1 through 50... owed a duty to operate DEFENDANT VEHICLE with the ordinary care and skill necessary to avoid causing harm to PLAINTIFF," states the document.

Calderon's legal team asserts that Ruth's negligent driving not only breached this duty but also violated specific California Vehicle Codes §§ 22350 (basic speed law) and 21453(c) (failure to stop at a red signal). These violations are cited as direct causes of Calderon's injuries. The plaintiff's counsel emphasizes that these laws were designed to protect individuals like Calderon from precisely such dangerous behavior on the road.

In his prayer for relief, Calderon seeks general damages according to proof presented during trial, compensation for past and future medical expenses, lost earnings both past and future, loss of earning capacity, pre- and post-judgment interest, costs of suit incurred, and any other relief deemed just by the court. Essentially, Calderon is asking for comprehensive financial restitution for all losses incurred due to the accident.
