A serious car accident has led to a significant legal battle in Ventura County. On June 13, 2024, Luis Tadeo Martinez filed a complaint in the Superior Court of California, County of Ventura, against Antonia Marie Mabry and Steve Ray Thomas for personal injuries resulting from alleged negligence.
According to the complaint filed by Alder Law, P.C., on behalf of Martinez, the incident occurred on June 24, 2022. Martinez was driving northbound on the 101 freeway in Ventura when his vehicle was struck from behind by a 2007 Blue Chevy Silverado driven by Mabry. The plaintiff alleges that Mabry's failure to adhere to traffic conditions resulted in this collision. Furthermore, Martinez claims that Mabry and unnamed defendants were negligent, careless, reckless, and unskillful in operating their vehicle. As a result of this negligence, Martinez sustained disabling and serious personal injuries leading to pain and suffering.
The complaint also details another collision involving Martinez on the same day with a Black BMW driven by Steve Ray Thomas. Similar allegations are made against Thomas for negligently causing the collision which contributed to Martinez's injuries. The document emphasizes that both incidents have caused substantial non-economic damages such as pain and suffering as well as economic damages including medical expenses and loss of earnings.
Martinez is seeking several forms of relief from the court. For both causes of action against Mabry and Thomas respectively, he requests non-economic damages exceeding the court's minimum jurisdictional amount along with economic damages for past and future medical expenses. Additionally, he seeks compensation for loss of earnings and impairment of earning capacity. Pre-judgment interest and costs of suit are also demanded.
