Plaintiffs Allege Medical Malpractice Against Physician Leading To Cancer Diagnosis

A recent court filing has brought to light a serious medical malpractice claim involving significant allegations of negligence and failure in duty of care. The complaint, filed by Michelle Cross and Nicholas Quintana on May 31, 2024, in the Superior Court of California for Ventura County, names Dr. Karin Fu and other unnamed defendants as responsible parties.

According to the plaintiffs, Michelle Cross sought medical consultation from Dr. Karin Fu starting around September 18, 2019, due to a left breast lump. The complaint alleges that Dr. Fu and her associates failed to provide adequate diagnosis, treatment, and care for Michelle's condition. Despite undergoing various diagnostic tests and treatments prescribed by Dr. Fu and her team, Michelle's condition deteriorated over time, ultimately leading to a diagnosis of breast cancer.

The plaintiffs assert that the defendants acted negligently in several capacities including as physicians, surgeons, anesthetists, nurses, pharmacists, hospitals or hospital attendants among others. They claim that this negligence directly resulted in Michelle’s worsening condition. The complaint details how the defendants "carelessly and negligently instructed, examined, diagnosed, prescribed for," and treated Michelle Cross which led to severe physical pain and emotional distress.

Nicholas Quintana also joins the lawsuit citing loss of consortium due to his wife's suffering. He claims that as a result of the defendants' negligence he has experienced a significant loss in terms of support, services, love, companionship, affection, security, sexual relations among other elements crucial to their marital relationship.

The plaintiffs are seeking general damages exceeding the jurisdictional minimum of the court along with special damages according to proof presented during trial. They are also asking for compensation covering medical expenses incurred due to the alleged malpractice as well as future expenses anticipated because of ongoing medical needs.

Representing the plaintiffs is George Ellard from Bostwick & Peterson LLP based in Mill Valley. The case has been assigned Case No. 2024CU TRIMIO2 5641 at Ventura Superior Court where it will be presided over by Judge Brenda L. McCormick.
