Man sues after serious injuries from car accident

In a recent filing with the Ventura Superior Court, Maximilian K. Tamburro has lodged a personal injury complaint against Silvestre Santana and unnamed defendants. The complaint, filed on May 13, 2024, alleges negligence on the part of Santana and other unidentified parties.

According to the court documents submitted by Tamburro's legal representation from Lewitt, Hackman, Shapiro, Marshall & Harlan, the incident in question occurred on June 26, 2022. On that date, Tamburro was driving his 2005 Honda Odyssey southbound on Park Lane near its intersection with Los Angeles Avenue in Ventura County when he was struck by a 2015 Ford Escape operated by Santana. The plaintiff claims that the defendants' negligent actions directly led to serious and permanent injuries.

The lawsuit outlines several key points of negligence attributed to Santana and the other defendants. It is alleged that at the time of the accident, Santana and were either owners or operators of the vehicle involved in the collision. Furthermore, it is claimed that others acted negligently and recklessly, contributing to the accident. The complaint states: "Defendants... so negligently, carelessly and recklessly owned, operated, maintained and entrusted their said motor vehicles so as to directly and proximately cause same to violently collide with the motor vehicle operated by Plaintiff."

Tamburro asserts that due to this negligence, he has suffered significant physical injuries along with mental anguish. The document specifies: "Plaintiff was hurt and injured in his health, strength and activity... all of which said injuries have caused and continue to cause Plaintiff great mental, physical and nervous pain and suffering." Moreover, Tamburro anticipates long-term disability resulting from these injuries.

As a result of these alleged actions by Santana and others involved, Tamburro seeks various forms of relief from the court. He requests general damages according to California Code of Civil Procedure Section 425.11 for pain and suffering endured due to his injuries. Additionally, he seeks compensation for medical expenses incurred as well as future medical costs related to ongoing treatment needs. The plaintiff also demands compensation for loss of earnings both past and future due to his inability to work following the accident.
