Kathleen A. Kenne sues Community Corporation of Santa Monica for unlawful detainer proceedings

The lawsuit of Kathleen A. Kenne vs Community Corporation of Santa Monica, Inc., et al., was filed in the Court of Appeal of the State of California, Second Appellate District, Division Three, under the court case ID B3817722 on April 26th, 2024. The plaintiff is appealing a judgment entered in favor of the defendants after the trial court granted defendants’ motion for terminating sanctions.

The dispute arose when Community Corporation of Santa Monica (CCSM) initiated unlawful detainer proceedings against Kenne in November 2017. In response, Kenne filed a lawsuit against CCSM and five of its officers and employees—Tara Barauskas, Robert Connell, Durinda Abraham, Kyong Chang, and Alan Wittert. The complaint alleged that defendants conspired to evict Kenne and retaliated against her when she complained, protested, and asked for information from CCSM.

Kenne sought economic and non-economic damages, specific performance, exemplary and punitive damages, an accounting of rents plus ten percent interest among other reliefs. She also requested injunctive relief to temporarily or permanently enjoin the unlawful detainer actions filed by CCSM against her. The plaintiff represented herself throughout the litigation.
