Rosa M. Torres sues Los Angeles Unified School District for disability and age discrimination

In a lawsuit filed on April 26, 2024, Rosa M. Torres has sued the Los Angeles Unified School District in the Court of Appeal of the State of California, Second Appellate District, Division Five. The court case ID is B321698 and it was originally filed in the Superior Court of Los Angeles County with the case number 18STCV079438.

The plaintiff, Rosa M. Torres, represented by Janet R. Gusdorff from Gusdorff Law, alleges that she faced disability and age discrimination at her workplace. She was hired by the defendant in September 2015 as a PSA counselor and began working at Columbus Middle School in August 2016. Despite having a discernable limp due to a leg injury sustained in 1975 while working for the United States Postal Service, she was deemed "free from any disabling disease" after her required physical examination upon hiring.

The lawsuit revolves around allegations under FEHA (California Fair Employment and Housing Act) for disability and age discrimination, failure to provide reasonable accommodation, failure to engage in good faith interactive process, retaliation for complaining about failure to accommodate and discrimination, and failure to prevent discrimination and retaliation. In March 2017, Torres received notice from the defendant that she was being considered for "non-reelection" effective June 30, 2017. Her initial complaint against the defendant was filed in December 2018.
