The lawsuit originated from a dispute between Quinn and her neighbors over excessive noise caused by their roosters and dogs over a four-year period. The plaintiff alleges that this noise led to emotional and psychological distress. In response to Quinn's lawsuit, defendants Carlos Martinez Beltran III and Regina Puckett filed an anti-SLAPP motion which was granted by the trial court along with an award for attorney fees and costs.
Quinn is seeking compensatory damages, punitive damages, and injunctive relief for alleged abuse of process and conspiracy to commit abuse of process. She asserts that after obtaining restraining orders against her in 2019 and 2020, Beltran intentionally provoked her into violating these orders through excessive animal noise.
Justices Gilbert, Yegan and Cody have declared that all of the plaintiffs appeals including the improper use of restraining orders, erring of judicial notice of her nolo contendere plea, not immunizing the defendants illegal acts, abuse of process, and unreasonable attorneys fees lack the necessary credibility and legal standing. All judgments of the lower court are affirmed.
