Kenmark Ventures sues Anthony Thomas for a dispute over a settlement agreement and stipulated judgment

Thomas appealed the trial court's denial of his motion to declare the settlement agreement and stipulated judgment void. He alleges that he only consented to these documents because his lawyers lied about their content and his liability. In December 2008, Kenmark sued Thomas, Electronic Plastics, LLC (Electronic), and Michael Gardner for money due on a promissory note, default under a security agreement, possession of collateral, common count for money lent, and fraud. This lawsuit stemmed from an alleged loan agreement between Kenmark and Thomas for $6,110,000 to develop proprietary biometric smartcard technology. As security for the loan, Thomas allegedly provided an emerald valued at over $500 million.

Kenmark is seeking judgment against Thomas for failing to honor the terms of their agreement. The plaintiff alleges that despite demands made in October 2008 for immediate payment of the $6,110,000 owed under the note and return of the emerald used as collateral, Thomas refused to comply.
