Mehdi Amini Moghadam sues Rodeo Realty for failure to disclose rental restriction

In the case of Mehdi Amini Moghadam et al. v. Rodeo Realty et al., filed in the Superior Court of Los Angeles County, with the court case ID 20STCV47310 on April 17, 2024, plaintiffs Mehdi Moghadam and Parvin Mirabadi have accused their real estate agents and the sellers of a property they purchased for failing to disclose that they could not rent out the property for the first two years of ownership. The defendants include Rodeo Realty and Sarah Kotler, among others.

The plaintiffs had hired Keller Williams Realty Westlake Village and its agent Mark Rader to represent them in purchasing a property at 14960 Dickens Street, Sherman Oaks, California in August 2019. They alleged that all defendants were aware of their intention to use the property as an income source through rental but did not inform them about the rental restriction.

The plaintiffs seek judgment for professional negligence, breach of contract, concealment, negligent misrepresentation, and negligent infliction of emotional distress against the listing defendants. The trial court sustained without leave to amend the listing defendants’ demurrer. The plaintiffs are appealing from the judgment of dismissal entered upon that ruling.
