Jonie A. Holland sues Silverscreen Healthcare for wrongful death and dependent adult abuse

In the case of Jonie A. Holland et al. v. Silverscreen Healthcare, Inc., filed in the Second Appellate District Division Two court in California (case ID B323237), dated April 16, 2024, the plaintiffs Jonie A. Holland and Wayne D. Womack are suing Silverscreen Healthcare for wrongful death and dependent adult abuse following the death of their son, Skyler A. Womack.

The lawsuit details that Skyler was a resident at Asistencia Villa Rehabilitation and Care Center, a skilled nursing facility operated by Silverscreen Healthcare. On January 5, 2020, Skyler signed an arbitration agreement with Asistencia which included clauses for disputes related to medical malpractice and care provision services provided by the facility. The plaintiffs' legal representation includes Steven C. Peck and Adam J. Peck from Peck Law Group.

Silverscreen Healthcare moved to compel arbitration based on this agreement after the plaintiffs filed a complaint alleging multiple falls and infections suffered by Skyler under Asistencia's care led to his untimely demise on October 29, 2020. The trial court granted Silverscreen's motion for survivor claims but denied it for wrongful death action as the parents did not have an enforceable arbitration agreement with Asistencia.
