Evan Mancuso sues Contractors State License Board for revocation of his contractor's license and order to pay investigation and enforcement costs

Evan Mancuso has filed a lawsuit against the Contractors State License Board (CSLB) in the Court of Appeal of the State of California, Second Appellate District, Division Five. The case ID is B327280 and was filed on April 17, 2024. The suit stems from the revocation of Mancuso's contractor's license by the CSLB and his subsequent order to pay for investigation and enforcement costs due to violations of three provisions of the Contractors’ State License Law.

Mancuso, who represented himself in court, had his contractor's license since 1988. The case involves a homeowner complaint related to an accessory dwelling unit (ADU) contract worth $74,000 with Red Vision Construction Inc., where David Acosta worked. However, when financing issues arose, Acosta suggested a loan through Energy Efficient Equity (E3) for a lower amount of $68,900 that listed Mancuso as the contractor instead of Red Vision.

The conflict began when Mancuso signed a Certificate of Completion for three energy certified items - an air conditioner, tankless water heater, and roofing - even though they were not installed by December 2018. Subsequently, E3 disbursed the entire loan amount to Mancuso who then transferred $60,000 to Acosta in three separate payments while retaining $8,900.

Mancuso seeks judicial review of the Board’s decision that revoked his license for at least three years and ordered him to pay costs associated with investigation and enforcement. He filed a petition for a writ of administrative mandamus after his writ petition was denied by the trial court.
