Spencer S. Mays sues IH4 Property West for violation of the Los Angeles Rent Stabilization Ordinance and intentional infliction of emotional distress

Spencer S. Mays has filed a lawsuit against IH4 Property West, LP and IH2 Property West LP in the Superior Court of Los Angeles County (case ID: 21STCV23662) on April 16, 2024. The case is being overseen by Judge Michael P. Linfield. Mays is represented by Lorden & Reed and Zshonette L. Reed, while the defendants are represented by Olson Law Group, Sonali Olson, and Sherri E. Matta.

Mays alleges that after acquiring title to her leased property at 4011 Hubert Avenue, the defendants unlawfully filed a detainer action against the property's former owner and all occupants without naming her as a defendant. In November 2014, IH4 obtained a judgment against the persons named in the unlawful detainer proceeding.

On January 13, 2017, Mays filed a claim to right of possession of the property which was countered with a successful motion for summary judgment by IH4. While an appeal was pending, Mays was evicted from the property on May 21, 2017.

Mays is seeking restitution damages for violation of the Los Angeles Rent Stabilization Ordinance (LARSO) and intentional infliction of emotional distress. She asserts that her claims are not based upon the underlying unlawful detainer action but upon defendants' violation of LARSO.
