In the Court of Appeal of the State of California, Second Appellate District, Division Three, a case was filed by plaintiff William C. Milks ITI against defendants Affirmed Technologies LLC and Dwight J. Baum. The court case ID is B330311 and it was filed on April 5, 2024.

The lawsuit revolves around allegations of breach of promissory notes and intentional misrepresentation. Milks, represented by Monti J. Stegen from Law Office of Monti J. Stegen, claims that he loaned Affirmed Technologies approximately $325,000 between 2009 and 2011 in exchange for 15 promissory notes ranging from $10,000 to $30,000 each which were not repaid. Baum, represented by Wade Beavers from Fennemore Craig, seized control of Affirmed in 2017 and is alleged to be its alter ego.

Milks is seeking judgment for his claims for breach of promissory notes and intentional misrepresentation which were dismissed as time-barred by the trial court. He also contests the awarding of attorney fees to Baum arguing that he was not a signatory to the relevant contracts and had not been adjudicated the alter ego of defendant Affirmed Technologies LLC.
