Taian operated the business for six months before returning it to Wannes and backing out of the transaction due to alleged fraudulent misrepresentation about the profitability of the business and operating condition of fuel dispensing tanks and equipment by Wannes. The plaintiff is seeking return of all sums paid to purchase the business which includes $150,000 delivered directly to Wannes in cash bags outside escrow.
