Monique Howard sues Accor Management US for negligence and premises liability

Monique Howard, the plaintiff, filed a lawsuit against Accor Management US, Inc., the defendant, in the Court of Appeal of the State of California, Second Appellate District, Division Eight. The court case ID is B320603 and it was filed on March 13th, 2024. The lawsuit revolves around an incident that occurred during Howard's stay at a hotel operated by Accor where she suffered injuries due to a faulty shower head.

Represented by Nguyen Theam Lawyers and Guenard & Bozarth, Howard claimed that she cut herself and fell when the handheld shower head in her hotel room fell apart. This incident happened in March 2017 at the Sofitel Los Angeles at Beverly Hills. She asserted that this accident left her with severe injuries and sued for negligence and premises liability.

On the other hand, Accor Management US, Inc., represented by Gordon Rees Scully Mansukhani lawyers, moved for summary judgment arguing they had no actual or constructive notice of any problem with the handheld shower head. They did not contest that the shower head came apart while Howard was showering but maintained they were unaware of any issues prior to the incident.

Howard is seeking judgment for damages caused by her fall due to what she claims was negligence on part of Accor Management US, Inc. She alleges that their failure to maintain safe premises led to her injuries. However, the trial court granted summary judgment in favor of Accor because Howard failed to establish a triable issue of material fact on key issues.
