Online women's shapewear retailer, Shapermint, has been accused in a class action lawsuit of allegedly enrolling customers into a costly membership plan without their consent.
The plaintiffs, Frances Fernandez and Cecille Nguyen, represented by attorneys from the frim of KalielGold PLLC and The Johnson Firm, allege that Shapermint systematically violated the California Automatic Renewal Law. They claim that the company enrolled consumers into automatic-renewal or continuous service membership subscriptions without providing clear disclosures as mandated by California law.

According to the complaint, when a consumer completes a purchase through Shapermint's website, they are automatically enrolled into the Shapermint Club. This club carries a $4.99 monthly fee that renews automatically. The plaintiffs also argue that upon discovering the hidden membership enrollment and associated monthly fee, consumers must navigate through an allegedly difficult and confusing process to cancel their Shapermint Club membership.
The plaintiffs are seeking remedies for violations of various California Business & Professions Codes, the Consumer Legal Remedies Act, the Washington Consumer Protection Act, unjust enrichment, and conversion.
