SAN DIEGO - Food products manufacturer Lenny & Larry's has been hit with a class action lawsuit accusing the company of misleading consumers about the probiotic content of its "immunity bars."
The lawsuit, filed by plaintiffs Samuel Garcia and Samantha Kotcher, alleges that the company's claims of supporting immune health are deceptive.
The suit argues that the bars do not contain enough BC30 Probiotic to support these claims. BC30 Probiotic is a proprietary probiotic made by Ganeden, a subsidiary of Kerry Group, and is touted on the product's label as supporting immune health and protein absorption.
The case was filed in the U.S. District Court for the Southern District of California.
The lawsuit claims Lenny & Larry's labeling of the products breaches its express warranty to consumers, while also allegedly violating California and New York consumer protection laws.
The plaintiffs are seeking a court order directing the defendants to pay statutory penalties and unspecified compensatory and punitive damages, plus attorney fees.
