Welch Foods is facing a class action lawsuit over alleged false advertising claims on its light grape juice product.
The suit, filed by named plaintiff Veronica Bustamante, of San Diego County, on behalf of all similarly affected consumers, accuses the company of misleading marketing practices.
According to the complaint, Welch's light grape juice packaging states that it contains "No Artificial Flavors or Preservatives." However, according to the complaint, the product also includes ascorbic acid, which it asserts is an artificial preservative ingredient used in beverage products.
Bustamante, who allegedly purchased the product in California, alleges that this misrepresentation led her and other consumers to believe they were buying a premium product free from artificial preservatives.
The lawsuit was filed March 1 in federal court in San Diego.
The plaintiffs are seeking unspecified damages, including restitution, and attorney fees.
They are represented by attorneys Michael T. Houchin, Craig W. Straub and Zachary M. Crosner, of Crosner Legal PC, of Beverly Hills.
