A class action lawsuit has accused the makers of the ClarityRX line of skin care products of allegedly spamming their phones with allegedly unwanted promotional text messages.
On March 1, named plaintiff Michelle Love filed suit against Clarity Clinical Skincare on behalf of herself and others who have allegedly received unwanted promotional text messages from the company. The case was filed in the U.S. District Court for the Central District of California, Western Division.
The plaintiff alleges that despite requesting to be placed on the company's internal do not call list, she and other members of the proposed class continued to receive marketing text messages from Clarity. The lawsuit seeks penalties under the Telephone Consumer Protection Act (TCPA), which provides for a penalty of $500 per call, and up to $1,500 per call if the TCPA is willfully or knowingly violated.
The complaint emphasizes that privacy rights are being violated by such unsolicited telemarketing communications.
